Important Court of Appeals Ruling for Physicians
CSETB lawyers Daniel Corbet and Kenneth Willis recently achieved an important
victory for a firm client in the Michigan Court of Appeals. In an interlocutory appeal, the
Court of Appeals reversed a Wayne County Circuit Court decision denying summary
disposition of vicarious liability claims against a hospital client for the alleged
malpractice of a co-defendant surgeon. The trial court denied the motion because the
plaintiff contacted the surgeon for care after consulting the hospital’s physician referral
service.
The Court of Appeals’ decision shows that an independent physician’s hospital staff
privileges or physician marketing by a hospital does not necessarily create a reasonable
belief in a patient that the physician is an agent of the hospital for purposes of vicarious
liability. The firm recommends that its hospital clients aggressively defend vicarious
liability claims with trial court motions and, when necessary, with interlocutory appeals.

best in their practice areas. The selection process also included Best Lawyers peer-
reviews, with lawyers voting on a firm’s expertise, responsiveness, integrity, cost-

Recent Court of Appeals Decision Important to Medical Malpractice Defense
On August 27, 2015, the Michigan Court of Appeals affirmed a Wayne County Circuit
Court decision that granted a motion for summary disposition filed by Steve Bonasso.
The plaintiff had appealed the trial court’s dismissal of her complaint that was filed one
day before the statutory notice period had elapsed. The appeal was defended by Mr.
Bonasso and Erika Jost. During the pendency of the appeal, the Michigan Supreme
Court in Tyra v Organ Procurement Agency (April 14, 2015) confirmed that a medical
malpractice complaint filed during the statutory notice period does not commence an
action. Based on the Supreme Court’s decision in Tyra, the Court of Appeals affirmed
the dismissal.
As this Court of Appeals decision demonstrates, the effect of the Tyra ruling is
significant for defendants in medical malpractice actions. The decision emboldens
defendants to seek and achieve dismissals of complaints that are filed even one day
before the mandatory notice period elapses. Additionally, it highlights the advantage to
defendants of filing a response to a notice of intent to sue, thereby lengthening the
notice period and creating more opportunity for plaintiffs to make a procedural error
potentially fatal to a claim.

Chris graduated from Thomas M. Cooley Law School and was
admitted to the bar in 2001. He worked for the Office of the
Florida State Attorney General before practicing with firms
in Florida and Michigan. Prior to joining Corbet, Shaw,
Essad & Bonasso, Chris worked for Brown,
Jacobson, P.C. in Norwich, Connecticut representing
corporate clients, insurance companies and municipalities.
His practice at CSETB focuses on civil litigation,
concentrating on medical malpractice defense.

announce that Sarah Tupica Berard has been promoted to
Associate Principal, in recognition of her legal skills,
commitment to clients and contributions to the firm. Berard,
who earned her Juris Doctorate from the University of
Detroit Mercy, joined the firm in 2009. Her practice focuses
on medical malpractice and insurance defense.
In 2012, Berard was
selected to serve on the newly-formed Patient and Family
Advisory Board (PFAB) at the University of Michigan
Comprehensive Cancer Center (UMCCC). The PFAB is a
partnership of patients, family members, healthcare
providers and the community that works to ensure the highest
quality of patient and family-centered care at UMCCC. Berard
was also elected as the PFAB Nominations and
Governance Officer.
In 2010 and 2011, Berard was named a

Kenneth M. Essad

Executive Board of the Veteransʼs Outreach Project of
Southeast Michigan, Inc. Essad took the lead to
incorporate the organization as a 501(c)(3) and will act
in a volunteer advisory capacity as Counsel to the
Board.
The Veterans’ Outreach Project
supports the 17th Judicial District Veterans Treatment
Court in Redford. Based on the successful model of drug
courts, Veterans Treatment Courts address challenges
unique to our nation’s veterans. These specialized
courts route offenders into substance abuse or mental
health treatment instead of incarceration and provide
social services to help them rehabilitate and readjust.

Erika Jost
has joined Corbet, Shaw, Essad & Bonasso as
an associate.
Jost graduated from Kalamazoo
College in 2008 with a bachelor’s degree in philosophy.
As part of her undergraduate program, she studied German
language and history at Friedrich-Alexander-Universitaet
Erlangen-Nuernberg. Jost earned her Juris Doctorate from
the University of Michigan Law School in 2011. While in
law school, Jost served as a board member for the
Michigan Law chapter of the American Constitution
Society. She also performed transactional work for local
small businesses and nonprofit corporations through the
Urban Communities Clinic (now the Community and Economic
Development Clinic). Upon graduation from law school,
Jost clerked for the Honorable Kay Behm, Probate Judge
assigned to the Family Division of Circuit Court in
Genesee County.
Ms. Jost was admitted to the bar
in the State of Michigan in 2011. Her practice focuses
on civil litigation, concentrating on medical
malpractice defense and appellate practice, and family
law.

actions/1983), long-term care litigation, and premises

asked by Michigan Supreme Court Justice Marilyn Kelly to
serve on the newly created Solutions on Self-Help Task
Force.
The SOS
Task Force is charged with developing resources for
non-lawyers who represent themselves in legal proceedings.
This will include an interactive and user-friendly self-help
website with centralized, high quality resources in several
languages. The overall goal is to close the gaps and
duplication in the availability, quality and uniformity of
self-help resources available to Michigan residents.
Essad
accepted the appointment to help the growing number of
Michigan residents who are being turned away from legal aid
agencies, which are overwhelmed by the demand for legal
help. The SOS Task Force will help provide an effective and
accessible alternative for people around the state.
